What is a Process Server?
Process Servers can deliver court documentation (serve) to a particular person or defendant involved with a court case.
If somebody does not pay child support, goes into bankruptcy through failing to pay bills, breaks their rental agreement unlawfully, or is otherwise instructed to go to court, they must be delivered with an ‘Order’ notifying them of the impending charges and also the court date. Notifying the defendant will be the responsibility of the individual (or company) filing the notice. Even in this technological age, a phone call or e-mail is not appropriate; the law expresses that the defendant would have to be notified face-to-face of the impending proceedings against them. Having said that, not just anyone can serve the court documents. That’s where the process server comes in.
In case a Process Server cannot deliver the paperwork to the defendant, they may also effect service by using ‘Substituted Service’. This means, they will rather deliver the paperwork through insertion in the letterbox or in another way that it’s going to come to the attention of any person stepping into the property, for instance, stick to the entry door.
